General Terms and Conditions
§ 1 General
- These General Terms and Conditions ("GTC") apply exclusively to all business relationships with the Scandinavian Aeromedical Academy ("the Academy"). The courses are offered solely to licensed medical doctors acting in a professional capacity. Consumer protection rules do not apply.
- Amendments or modifications to the contract must be made in writing in order to be valid, unless expressly agreed otherwise.
- The Academy provides training modules fulfilling the legal and professional requirements for theoretical training and continuing education for Aero Medical Examiners (AMEs) under EASA regulations and for qualification in Aviation Medicine according to the continuing education ordinances of the National Medical Associations in EASA member states.
§ 2 Registration
- Registration must be carried out in writing using the registration forms provided on www.aeromedical.academy and must be accompanied by proof of medical qualification and specialist authorisation. By submitting a registration, the participant makes a binding offer to conclude a contract.
- Registrations are processed in the order in which they are received. Upon approval, the participant receives a written confirmation, which constitutes the conclusion of the contract. If a course is fully booked, the participant will be notified and offered a place on the waiting list.
§ 3 Course Fees and Services
- Course fees include course materials, tuition, conference facilities, catering during breaks, and lunch.
- Prices include any applicable VAT unless otherwise specified.
§ 4 Payment
- Course fees are payable within 14 days of receipt of the invoice.
- Payment must be made via wire transfer to the account stated on the invoice. Payment is deemed completed when the funds are credited to the Academy's account.
- In case of late payment, the Academy is entitled to charge statutory default interest and may claim further damages.
- The Academy may exclude the participant from the course until full payment has been made.
§ 5 Withdrawal and Cancellation by the Participant
- As participation is offered exclusively to medical professionals in a B2B context, ordinary cancellation is excluded once registration is confirmed. The right to extraordinary cancellation for material breach remains unaffected.
- If the participant withdraws, the Academy may charge reasonable compensation for preparations made and expenses incurred.
- Cancellation is possible up to three months before the start of the course unless otherwise stated in the offer or confirmation.
- If withdrawal occurs later than three months before the course start, 50% of the course fee is charged. If withdrawal occurs later than four weeks before course start, 75% is charged. If the Academy succeeds in filling the vacant place, the cancellation fee is reduced by 50%.
- After the course has begun, withdrawal is not possible. The same applies in case of non-attendance without notification.
- The participant may demonstrate that lower damages were incurred; the Academy may also demonstrate higher damages.
- Withdrawal or cancellation must be submitted in writing. The date of receipt determines compliance with deadlines.
- The right to participate is non-transferable.
- Absence, including due to illness, does not entitle the participant to a fee reduction.
§ 6 Necessary Programme Changes
The Academy may make changes to dates, instructors or minor adjustments to course content, provided that the overall character and purpose of the course remain unchanged.
§ 7 Impossibility, Force Majeure and Withdrawal by the Academy
- The Academy may cancel or postpone the course due to force majeure.
- Force majeure under Danish law includes, but is not limited to:
- war, terrorism, civil unrest
- natural disasters, epidemics, pandemics
- fire, explosion, major IT-breakdown
- labour disputes not caused by the Academy
- orders, prohibitions or materially restrictive requirements issued by public authorities
- circumstances which are beyond the Academy's reasonable control and which the Academy could not foresee or avoid
- If the course is cancelled due to force majeure, loss of venue, withdrawal of approval by the authorities, or other circumstances for which the Academy is not responsible, there is no entitlement to completion of the course.
- If the course cannot reasonably be conducted due to insufficient enrolment, the Academy may withdraw.
- The Academy will inform participants without undue delay in all cases.
§ 8 Exclusion of Participants
- Participants may be excluded if they:
- are under the influence of alcohol or intoxicants, or
- fail to comply with safety regulations at partner facilities
- In such cases, no refund is granted. The participant may demonstrate that no or lesser damage occurred.
§ 9 Event Site
The Academy reserves the right to change the venue at short notice.
§ 10 Duration of Courses
Course start, duration and end dates appear in the registration materials. Changes will be communicated to participants.
§ 11 Prerequisites for Participation
Participation in Basic and Advanced courses requires medical authorisation and recognised specialist qualification in any clinical medical specialty.
§ 12 Requirements for Certified Specialisation in Aviation Medicine
- Participants must provide documentation of recognised medical specialisation in any clinical medical specialty.
- Theoretical requirements are fulfilled by completing:
- Basic course → AME Class 2, LAPL, CC certification
- Basic + Advanced → AME Class 1 and Class 3 certification
§ 13 Certification by the Danish Civil Aviation Authority
According to the Academy's current knowledge, The Danish Civil Aviation Authority certifies the Basic and Advanced courses with 60 points each. Participants will be informed of any changes received by the Academy.
§ 14 Liability
- In a B2B relationship, the Academy is liable only for:
- breach of an essential contractual obligation (cardinal obligation),
- damage caused by gross negligence or wilful misconduct, or
- injury to life, limb or health
- In cases of negligent breach of a cardinal obligation, liability is limited to typical, foreseeable damages.
- Liability under the Danish Product Liability Act remains unaffected.
- The cabin training and the flight experience offered during the Basic course is conducted solely under the compulsory insurance of the aircraft owner. The Academy does not provide additional aviation insurance. Participation occurs at the participant's own risk and insurance.
§ 15 Copyright
- Participants receive a simple, non-exclusive, non-transferable and non-sublicensable right to use course materials for personal professional purposes.
- Course materials may not be reproduced, distributed or modified, in whole or in part.
- Photography, video, film or audio recording is prohibited unless expressly approved by both the Academy and the instructor.
§ 16 Data Protection
The Academy complies with applicable data protection law, including GDPR. Personal data is processed only as necessary, and all staff are subject to confidentiality and data protection obligations.
§ 17 Limitation Period
In this professional B2B context, contractual claims expire one year after the participant becomes aware, or should have become aware through gross negligence, of the circumstances giving rise to the claim.
§ 18 Choice of Law and Severability
- These GTC are governed by Danish law.
- If any provision is or becomes invalid, the remaining provisions remain fully effective.
Cancellation Policy
Right of Cancellation
You may withdraw from the contract within 14 days in text form (letter or email) without stating a reason. The period begins upon receipt of this notice. Timely dispatch suffices for compliance.
Consequences
Payments received will be refunded within 30 days of receipt of the cancellation notice.
